Terms of service

These terms are an agreement between you, the merchant who installs the Colouroo app in a Shopify store, and Colouroo Pty Ltd of 11 Maud Street, Newstead QLD 4006, Australia ("Colouroo", "we", "us"). By installing or using the app you agree to them. If you are installing it on behalf of a business, you confirm you are allowed to bind that business.

1. What Colouroo does

Colouroo lets you put your designs on garments and other blank products from our catalogue, publish them to your Shopify store, and have each order printed and posted to your customer as it comes in. Products are made to order; we hold no stock for you and you buy nothing up front.

2. Your account

You use Colouroo through your Shopify account, and you are responsible for anyone who uses it through your store. Keep your Shopify login secure. You must be at least 18 and able to enter a contract.

3. Prices and payment

  • The price we charge you for each product (blank, print and any extra print positions) is shown in the app before you publish. Postage is charged per order (a first-item rate plus a rate for each extra item) and matched to the shipping method your customer chose. All prices are in Australian dollars and include GST unless stated otherwise.
  • You set your own retail prices. Your customer pays you through your Shopify checkout; that sale is between you and your customer.
  • You must keep a valid payment card on file with us. Card details are held by our payment processor, Stripe, not by us. By saving a card you authorise us to charge it for each order, including postage, without further approval from you.
  • You choose an approval window (straight away, one hour or 24 hours) after which each order is charged. Until an order is charged you can cancel it in Shopify at no cost.
  • An order is not printed until it is paid. If a charge fails, the order is held and we tell you why; it stays on hold until you fix the card and retry. Where your bank requires you to confirm a charge, we will ask you to do so in the app.
  • We issue a tax invoice for every charge and email it to your store's contact address.
  • We may change our prices. Changes apply to orders placed after the change appears in the app, never to orders already charged.

4. Production and delivery

  • Orders are usually printed within the production time shown in the app (measured in business days, Brisbane time) and posted with Australia Post or another carrier. Delivery estimates are estimates; we do our best but do not guarantee a delivery date, and we are not responsible for carrier delays.
  • We post to the address your customer gave at checkout. If it is wrong, tell us before the order is printed and we will fix it; after posting, a redelivery or re-print is at your cost.
  • Tracking numbers are passed to your Shopify store so your customer receives Shopify's normal shipping notification.

5. Cancellations, misprints and returns

  • Before an order is charged you can cancel it in Shopify free of charge.
  • After it is charged but before printing starts, cancelling in Shopify refunds the charge to your card.
  • Once printing has started an order cannot be cancelled and is not refundable, because it is made for you.
  • If a product arrives misprinted, damaged or not as ordered, tell us within 14 days of delivery with photos and we will reprint it or refund what you paid for it, at our choice. This is our reprint guarantee and it does not limit any rights under the Australian Consumer Law.
  • Because products are made to order, we do not accept returns for change of mind, wrong size ordered, or a design you are unhappy with once it has been printed as you supplied it. What you offer your own customers in those cases is your decision and your cost.
  • Colours on screen and on fabric never match exactly. Small differences in colour, placement (within a few millimetres) and the look of a print on different fabrics are normal and are not defects.

6. Your designs and content

  • You keep ownership of everything you upload. You give us a licence to store, reproduce and print it, and to show it in mockups, only for the purpose of providing the service to you.
  • You confirm that you own or have permission to use every design you upload, including any logos, characters, photographs, fonts and text in it, and that printing and selling it does not infringe anyone's rights or break any law.
  • We will not print material that is illegal, that infringes someone else's rights, or that we consider hateful, defamatory or otherwise unacceptable, and we may cancel and refund such orders or remove such products at our discretion.
  • If someone makes a claim against us because of something you uploaded, you agree to cover our reasonable costs of dealing with it.

7. Your Shopify store and your customers

You are the seller of record to your customers. You are responsible for your own store, your product listings, your prices, your customer service and your own refund and returns policy. We provide the printing and delivery behind the scenes. When you install the app you give it permission to create and update products in your store and to read orders for Colouroo products, and nothing else.

8. Privacy

How we handle your information and your customers' information is set out in our privacy policy, which forms part of these terms.

9. The service

We work hard to keep the app available and accurate but cannot promise it will always be free of interruptions or errors. We may change, add or remove features, products, colours and sizes, and may suspend the service for maintenance. We may also suspend or close your access if you breach these terms, if charges repeatedly fail, or if we reasonably suspect misuse.

10. Liability

Nothing in these terms excludes rights you have under the Australian Consumer Law that cannot be excluded. Otherwise, to the extent the law allows, our total liability to you for any claim connected with the service is limited to the amount you paid us for the order the claim relates to, and we are not liable for indirect losses such as lost sales or profits. Where the law lets us limit our liability for a service to re-supplying it or paying the cost of re-supply, we do so.

11. Ending the agreement

You can stop using Colouroo at any time by uninstalling the app from your Shopify store. Orders already charged will still be completed. Uninstalling does not remove Colouroo products from your store; delete those in Shopify if you no longer want to sell them. We can end the agreement on reasonable notice, or immediately if you breach these terms.

12. General

These terms are governed by the laws of Queensland, Australia, and the courts there. If part of these terms is found invalid the rest still applies. We may update these terms; we will show the new date at the top and, for significant changes, tell you by email or in the app. Continuing to use the app after a change means you accept it.
